1. Charakter Usługi

Przedmiotem transakcji w sklepie .Proximiter, obsługiwanym przez Tebex Limited, jest cyfrowa subskrypcja członkowska („Proximiter Supporter”) w obrębie ekosystemu społecznościowego Discord.

• Dostęp do Społeczności: Nabywając status Proximiter Supporter, użytkownik otrzymuje dostęp do prywatnych kanałów komunikacyjnych, bezpośredniego wsparcia technicznego oraz wglądu w proces rozwoju projektu .Proximiter.
• Brak sprzedaży oprogramowania: Transakcja nie stanowi zakupu gry, modyfikacji ani modeli 3D. Wszelkie materiały udostępniane wewnątrz zamkniętej grupy są wynikiem prywatnych prac badawczych twórcy i nie stanowią przedmiotu sprzedaży handlowej.

2. Licencjonowanie i EULA

Dostęp do materiałów autorskich (m.in. plików fizyki, telemetrii, konfiguracji) udostępnianych wewnątrz strefy Proximiter Supporter jest regulowany odrębną licencją użytkownika końcowego (EULA).

• Prawa Autorskie: Właścicielem wszelkich autorskich algorytmów i konfiguracji jest Piotr Polinkiewicz. Pobranie lub korzystanie z tych materiałów wymaga akceptacji warunków EULA, która zabrania ich kopiowania, dekompilacji oraz udostępniania osobom trzecim.
• Zgodność z Assetto Corsa: Projekt .Proximiter jest niezależny od Kunos Simulazioni. Korzystanie z materiałów twórcy wymaga posiadania legalnej kopii gry bazowej.

3. Licencje Steam i Brak Transferu

W ramach członkostwa, użytkownik może otrzymać indywidualnie wygenerowane licencje dostępowe przypisane do konkretnego konta w ekosystemie Steam.

• Blokada Konta: Licencja jest generowana jednorazowo i trwale wiązana z identyfikatorem SteamID podanym przez użytkownika.
• Brak możliwości zmiany: Po wygenerowaniu licencji nie ma możliwości jej przeniesienia na inne konto Steam ani zmiany identyfikatora SteamID pod jakimkolwiek pozorem.

4. Polityka Zwrotów

Ze względu na natychmiastowy charakter świadczenia usługi (automatyczne przypisanie rangi Discord oraz generowanie dostępów) po dokonaniu płatności, wszystkie transakcje są ostateczne i nie podlegają zwrotowi.

5. Odpowiedzialność Użytkownika

Naruszenie regulaminu, zasad serwera Discord lub warunków licencji EULA skutkuje natychmiastowym odebraniem statusu Proximiter Supporter i blokadą dostępu do materiałów bez prawa do zwrotu kosztów subskrypcji.

1. Nature of the Service

The subject of the transaction in the .Proximiter store, powered by Tebex Limited, is a digital membership subscription ("Proximiter Supporter") within the Discord community ecosystem.

• Community Access: By acquiring Proximiter Supporter status, the user receives access to private communication channels, direct technical support, and insight into the development process of the .Proximiter project.
• No Software Sale: The transaction does not constitute the purchase of a video game, game modifications, or 3D models. Any materials shared within the closed group are the result of the creator's private research and are not subject to commercial sale.

2. Licensing and EULA

Access to proprietary materials (including physics files, telemetry, and configurations) provided within the Proximiter Supporter area is governed by a separate End User License Agreement (EULA).

• Intellectual Property: Piotr Polinkiewicz is the sole owner of all original algorithms and configurations. Downloading or using these materials requires acceptance of the EULA, which prohibits copying, decompilation, and redistribution to third parties.
• Assetto Corsa Compatibility: The .Proximiter project is independent of Kunos Simulazioni. Using the creator's materials requires owning a legal copy of the base game.

3. Steam Licenses and Non-Transferability

As part of the membership, the user may receive individually generated access licenses assigned to a specific account in the Steam ecosystem.

• Account Linking: The license is generated once and permanently linked to the SteamID provided by the user.
• No Transfer Policy: Once a license has been generated, it cannot be transferred to another Steam account or have the SteamID changed under any circumstances.

4. Refund Policy

Due to the instantaneous nature of the service delivery (automatic Discord role assignment and access generation) upon payment, all sales are final and non-refundable.

5. User Responsibility

Violation of the terms of service, Discord server rules, or EULA conditions will result in the immediate termination of Proximiter Supporter status and loss of access to materials without any right to a refund.
